Community Guidelines

1. Acceptance

By using or visiting our website (https://gospelcentral.us) or any of our other services or products delivered to you via the Gospel Central website or by using our mobile app or any of our other services or products delivered to you via our app (collectively the "Service") you are agreeing to (1) these terms and conditions (the "Terms of Service"), (2) Gospel Central’s Privacy Policy, found at https://gospelcentral.us/terms#privacy, and (3) Community and Video Guidelines, found at https://gospelcentral.us/terms#rules. If you do not agree to any of these terms, the Privacy Policy, or the Community and Video Guidelines, you should not use the service.

We may attempt to notify you when we make major changes to these Terms of Service, however, you should review the most up-to-date version from time to time (https:// gospelcentral.us/terms). We may, at our sole discretion, change, modify or revise these Terms of Service and policies at any time, and by agreeing to this Terms of Service, you agree to be bound by any modifications or revisions. Nothing in these Terms of Service shall be deemed to confer any third-party rights or benefits.

2. Service

These Terms of Service apply to all users of the Service, including users who are also contributors of Content on the Service. “Content” includes the videos, text, software, scripts, graphics, photos, sounds, music, audiovisual combinations, interactive features and other materials you may contribute to, search for, view on, or access through the Service. The Service includes all aspects of Gospel Central, and that includes but is not limited to all of the products, software and services offered via the Gospel Central website, such as the testimony pages, testimony player, profile pages, the “Testimony Builder”, and other applications.

The Service may contain references and links to third party websites that are not owned or controlled by Gospel Central. We have no control over, and we assume no responsibility for, the content, terms and conditions, privacy policies, or practices of any third party websites. In addition, we are unable to and will not police or edit the content of any third-party site. By using the Service, you expressly relieve Gospel Central from any and all liability arising from your use of any third-party website. Accordingly, we want you to be aware when you leave the Service and when you do, we encourage you to read the terms and conditions and privacy policy of each other website that you visit.

3. Gospel Central Accounts

In order to access some features of the Service, you will have to create a Gospel Central Account. You are prohibited from using another user’s account without permission. When you create your account, the information that you provide must be accurate and complete and you are solely responsible the activity that occurs on your account and for keeping your account credentials secure. You must notify Gospel Central immediately if you discover any unauthorized use of your account.

Gospel Central is not liable for your losses caused by any unauthorized use of your account, however you may be liable for the losses of Gospel Central or others due to such unauthorized use.

4. General Use of the Service—Permissions and Restrictions

Gospel Central hereby grants you permission to access and use the Service as set forth in these Terms of Service, provided that:

You agree that you will not distribute in any medium any part of the Service or the Content without Gospel Central's prior written authorization, unless the means for such distribution has been provided by Gospel Central through functionality offered by the Service.

You agree that you will not edit or alter or modify any part of the Service.

You agree that you will not access Content through any technology or means other than the Service.

You agree that you will not engage in the commercial sale of access to the Service.

You agree that you will not engage in the sale of sponsorships, promotions, or advertising placed on or within the Service or Content.

You agree that you will not create for use, use, or launch any automated programs or systems, including without limitation, "robots," "spiders," or "offline readers," that accesses the Service in a manner that sends more request messages to the Gospel Central servers in a given period of time than a natural person could reasonably produce in an equivalent period of time by using a standard on-line web browser. Notwithstanding the foregoing, Gospel Central grants the operators of public search engines permission to use spiders to copy materials from the site for the sole purpose of and solely to the extent necessary for creating publicly available searchable indices of the materials, but not caches or archives of such materials. Gospel Central reserves the right to revoke these exceptions either generally or in specific cases. You agree that you will not collect or harvest any personally identifiable information, including account names, from the Service. You agree that you will not use the communication systems that are provided by the Service or by third-party services incorporated into the Service (e.g., comments, email) for any commercial solicitation purposes. You agree that you will not solicit, for commercial purposes, any users of the Service with respect to their Content.

In your use of the Service, you agree that you will comply with all applicable laws. Gospel Central reserves the right to discontinue any aspect of the Service at any time.

5. Your Use of Gospel Central Content

The Content on the Service, and the trademarks, service marks and logos ("Marks") on the Service, are owned by or licensed to Gospel Central, subject to copyright and other intellectual property rights under the law.

The Content that we provide is provided to you AS IS. You are permitted to access Content for your own information and personal use solely as intended through the functionality provided by the Service and as permitted under these Terms of Service. You agree that you will not download any Content unless that specific Content is accompanied by a “download” or similar link. You agree that you will not download, copy, reproduce, distribute, transmit, broadcast, display, sell, license, or otherwise exploit any Content for any other purposes without the prior written consent of Gospel Central or the respective licensors of the Content. Gospel Central and its licensors reserve all rights not expressly granted in and to the Service and the Content.

You agree that you will not circumvent or attempt to circumvent, disable or attempt to disable, or otherwise tamper with security-related features of the Service or features that prevent or restrict use or copying of any Content or that are intended to enforce limitations on use of the Service or the Content therein.

When you use the Service, you acknowledge that you understand that when you use the Service you will be exposed to Content from a variety of sources. You also acknowledge that Gospel Central is not responsible for the quality, usefulness, accuracy, safety, or intellectual property rights of or relating to such Content. We make every effort to review the Content that exists on the Service, however, you also understand and acknowledge that you may be exposed to Content that is inaccurate, offensive, or objectionable, and you agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against Gospel Central with respect thereto, and, to the extent permitted by applicable law, agree to indemnify and hold harmless Gospel Central, its owners, operators, affiliates, licensors, and licensees to the fullest extent allowed by law regarding all matters related to your use of the Service.

6. Your Content and Conduct on Gospel Central

As a Gospel Central account holder you may submit Content to the Service, including videos and user comments. You acknowledge and understand that Gospel Central does not guarantee any confidentiality with respect to any Content you submit.

You are solely responsible for your own Content and the consequences of submitting and publishing your Content on the Service. When you submit Content to be published, you affirm, represent, and warrant that you own or have the necessary licenses, rights, consents, and permissions to publish that Content; and you license to Gospel Central all patent, trademark, trade secret, copyright or other proprietary rights in and to such Content for publication on the Service pursuant to these Terms of Service.

In order to be as clear as possible with regards to the intellectual property rights of the Content you submit to be published on the Service, you retain all of your ownership rights in your Content. However, by submitting Content to Gospel Central, you grant Rock Church, its ministries, affiliates and assignees, a worldwide, non-exclusive, royalty-free, sub-licensable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the Content in connection with the Service and Gospel Central’s business, including without limitation for promoting and redistributing part or all of the Service (and derivative works thereof) in any media formats and through any media channels.By submitting Content to Gospel Central you also grant each user of the Service a non-exclusive license to access your Content through the Service, and to use, reproduce, distribute, display and perform such Content as permitted through the functionality of the Service and under these Terms of Service.

The licenses that you grant, which are described above, terminate within a commercially reasonable time after you delete or remove your videos from the Service. You understand and agree, however, that Gospel Central may retain, but not display, distribute, or perform, server copies of your videos that have been removed or deleted. The above licenses granted by you in user comments you submit are perpetual and irrevocable.

You agree that Content that you submit to the Service will not contain third party copyrighted material, or material that is subject to other third party proprietary rights, unless you have permission from the owner of the material or that you are otherwise legally entitled to post the material and to grant Gospel Central all of the license rights granted herein.

You further agree that you will not submit to the Service any Content or other material that is contrary to the Gospel Central Community and Video Guidelines, currently found below, which may be updated from time to time, or contrary to applicable local, national, and international laws and regulations.

Personal Information of Children Under 13 Strictly Prohibited -- You further agree that no person under the age of 13 will be depicted or make statements or comments in or as part of any Content you submit to the Service. No personal information of a child under the age of 13 can be displayed, discussed, or disclosed, including but not limited to images (photo or video and copies or reproductions of the same), physical characteristics or features, full names, addresses (including city/state), social security numbers, telephone numbers (including cell), schools attended, and online contact information (including emails, screen/user names, including for any social media sites).

Community and Video Guidelines

All Content submitted to Gospel Central must adhere to the following:
  • Video file must be 500MB or smaller in file size.
  • Video, statements, or comments are testimony-based in topic.
  • Speaker is clearly understandable. This includes audio levels and clarity of speech. No electronic alterations or manipulations of the speaker’s voice.
  • Visual quality is acceptable. Video has no glitches, pixelation, or static issues. No electronic alterations or manipulations of the speaker’s image or any other person’s image.
  • Lighting is acceptable. Speaker is clearly visibly in the video.
  • Video, statements, or comments are consistent with the fundamentals of the Christian Faith:
    • The Trinity: I believe that God eternally exists as three persons, Father, Son, and Holy Spirit, and each person is fully God, and there is one God.
    • The Person of Jesus Christ: As the second person of the Trinity, I believe the Son reveals the Father. As fully God and fully man, Jesus Christ lived a sinless life, died to pay in full the penalty for our sin, rose bodily and miraculously from the dead, ascended into heaven, and will come again in glory.
    • The Holy Spirit: I believe that God lives inside of believers in the form of the Holy Spirit, who was promised by Jesus to give us power to be His witnesses according to Acts 1:8.
    • The Second Coming: I believe in our Lord’s promised return, which could occur at any moment. According to the Father’s plan, Jesus Christ will one day return in power to reward believers and bring judgment and wrath to unbelievers.
    • Salvation: I believe that the offer of salvation is God’s love-gift to humanity. Those who accept it by grace through faith, apart from works, become new creatures in Jesus Christ.
    • The Bible: I affirm my confidence in God’s inerrant Word. The 66 books of the Old and New Testaments are the Word of God, inspired by the Holy Spirit. The Bible is without error in its original manuscripts, is completely reliable as the final authority in all matters of doctrine and practice, and is centered on the person and word of Jesus Christ. The Bible is fully true in all that it teaches and affirms.
  • No rips of movies, music, television, or any other third party copyrighted material.
  • Modest attire. Choose attire that will not be a distraction from the impact of your testimony.
  • No sexually explicit material or pornography. This includes artistic and non-sexual nudity.
  • No videos, statements, or comments that are hateful, harass others, or include defamatory or discriminatory speech.
  • No videos, statements, or comments that depict or promote unlawful acts, extreme or real-life violence, self-harm, or cruelty towards animals.
  • No videos, statements, or comments that include profanity in the form of words, expression, gestures, or other social behaviors that is construed or interpreted as insulting, vulgar, obscene, foul, or desecrating.
  • No videos, statements, or comments that promote or advertise for a person, organization or business.
  • No videos that are spam-based, intended as spam, or are known or should be reasonably be known as spam.
  • Full names of other individuals cannot be used in the video. Only first names are allowed. No home, residential, or commercial addresses should be identified, listed, or discussed.
  • Any person depicted or that speaks in, or as part of, the video, including whether that person speaks or not, must be 13 years of age or older at the time the video is or was recorded. No personal information of a child under the age of 13 can be displayed, discussed, or disclosed, including but not limited to images (photo or video), physical characteristics or features, full names, addresses (including city/state), social security numbers, telephone numbers (including cell), and online contact information (including emails, screen/user names, including for any social media sites).

You understand and acknowledge that Gospel Central may review any Content you submit to the Service before it is published. You further understand that Gospel Central is under no obligation to publish Content that you submit to the Service and that Gospel Central may, for any reason, choose to not publish the Content you submit or to remove Content you have submitted that was previously published.

Gospel Central does not endorse any Content submitted to the Service by any user or other licensor, or any opinion, recommendation, or advice expressed therein, and Gospel Central expressly disclaims any and all liability in connection with Content. Gospel Central does not permit copyright infringing activities and infringement of intellectual property rights on the Service, and Gospel Central will remove all Content if properly notified that such Content infringes on another's intellectual property rights. Gospel Central reserves the right to remove Content without prior notice.

Although the Service is normally available, there will be occasions when the Service will be interrupted for scheduled maintenance or upgrades, for emergency repairs, or due to failure of communications links and equipment that are beyond the control of Gospel Central. Also, although Gospel Central will normally only delete Content that violates this Agreement, Gospel Central reserves the right to delete any Content for any reason, without prior notice. Deleted content may be stored by Gospel Central in order to comply with certain legal obligations and is not retrievable without a court order. As a result, Gospel Central encourages you to maintain your own backup of your Content. For clarity, Gospel Central is not a backup service and Gospel Central will not be liable to you for any modification, suspension, or discontinuation of the Service, or the loss of any Content.

7. Account Termination Policy

It is important that you understand that Gospel Central can terminate your or any user's access to the Service if the user is determined to be an infringer. Gospel Central reserves the right to decide whether Content violates these Terms of Service for any reasons and for reasons other than copyright infringement, such as, but not limited to, pornography, obscenity, excessive length, inconsistency with the site’s theme, or inconsistency with the submission guidelines. Gospel Central may at any time, without prior notice and in its sole discretion, remove such Content and/or terminate a user's account for submitting such material in violation of these Terms of Service.

8. Digital Millennium Copyright Act

If you are a copyright owner or an agent thereof and believe that any Content infringes upon your copyrights, you may submit a notification pursuant to the Digital Millennium Copyright Act ("DMCA") by providing our Copyright Agent with the following information in writing (see 17 U.S.C 512(c)(3) for further detail): A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed; Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site; Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled and information reasonably sufficient to permit the service provider to locate the material; Information reasonably sufficient to permit the service provider to contact you, such as an address, telephone number, and, if available, an electronic mail; A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and a statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Gospel Central’s designated Copyright Agent to receive notifications of claimed infringement is Rock Church, 2277 Rosecrans St., San Diego, CA 92106, . You acknowledge that if you fail to comply with all of the requirements of this Section 5(D), your DMCA notice may not be valid.

Counter-Notice. If you believe that your Content that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the material in your Content, you may send a counter-notice containing the following information to the Copyright Agent:
Your physical or electronic signature; Identification of the Content that has been removed or to which access has been disabled and the location at which the Content appeared before it was removed or disabled; A statement that you have a good faith belief that the Content was removed or disabled as a result of mistake or a misidentification of the Content; and
Your name, address, telephone number, and email address, a statement that you consent to the jurisdiction of the federal court in San Diego, California, and a statement that you will accept service of process from the person who provided notification of the alleged infringement.
If a counter-notice is received by the Copyright Agent, Gospel Central may send a copy of the counter-notice to the original complaining party informing that person that it may replace the removed Content or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the Content provider, member or user, the removed Content may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the counter-notice, at Gospel Central's sole discretion.

9. Warranty Disclaimer

YOU AGREE THAT YOUR USE OF THE SERVICES SHALL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, Gospel Central, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICES AND YOUR USE THEREOF. Gospel Central MAKES NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THIS SITE'S CONTENT OR THE CONTENT OF ANY SITES LINKED TO THIS SITE AND ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR SERVICES, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR SERVICES, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH OUR SERVICES BY ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES. Gospel Central DOES NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY PRODUCT OR SERVICE ADVERTISED OR OFFERED BY A THIRD PARTY THROUGH THE SERVICES OR ANY HYPERLINKED SERVICES OR FEATURED IN ANY BANNER OR OTHER ADVERTISING, AND Gospel Central WILL NOT BE A PARTY TO OR IN ANY WAY BE RESPONSIBLE FOR MONITORING ANY TRANSACTION BETWEEN YOU AND THIRD-PARTY PROVIDERS OF PRODUCTS OR SERVICES. AS WITH THE PURCHASE OF A PRODUCT OR SERVICE THROUGH ANY MEDIUM OR IN ANY ENVIRONMENT, YOU SHOULD USE YOUR BEST JUDGMENT AND EXERCISE CAUTION WHERE APPROPRIATE.

10. Limitation of Liability

IN NO EVENT SHALL Gospel Central, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR SERVICES, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR SERVICES, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH OUR SERVICES BY ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.

YOU SPECIFICALLY ACKNOWLEDGE THAT Gospel Central SHALL NOT BE LIABLE FOR CONTENT OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU.

The Service is controlled and offered by Gospel Central from its facilities in the United States of America. Gospel Central makes no representations that the Service is appropriate or available for use in other locations. Those who access or use the Service from other jurisdictions do so at their own volition and are responsible for compliance with local law.

11. Indemnity

To the extent permitted by applicable law, you agree to defend, indemnify and hold harmless Gospel Central, its parent corporation, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms of Service; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your Content caused damage to a third party. This defense and indemnification obligation will survive these Terms of Service and your use of the Service.

12. Ability to Accept Terms of Service

You affirm that you are either more than 18 years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Service, and to abide by and comply with these Terms of Service. In any case, you affirm that you are over the age of 13, as the Service is not intended for children under 13. If you are under 13 years of age, then please do not use the Service. There are lots of other great websites for you. Talk to your parents about what sites are appropriate for you.

13. Assignment

These Terms of Service, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Gospel Central without restriction.

14. General

You agree that: (i) the Service shall be deemed solely based in California; and (ii) the Service shall be deemed a passive website that does not give rise to personal jurisdiction over Gospel Central, either specific or general, in jurisdictions other than California. These Terms of Service shall be governed by the internal substantive laws of the State of California, without respect to its conflict of laws principles. Any claim or dispute between you and Gospel Central that arises in whole or in part from the Service shall be decided exclusively by a court of competent jurisdiction located in San Diego County, California. These Terms of Service, together with the Privacy Notice at https://www.gospelcentral.us/terms#privacy and any other legal notices published by Gospel Central on the Service, shall constitute the entire agreement between you and Gospel Central concerning the Service. If any provision of these Terms of Service is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Service, which shall remain in full force and effect. No waiver of any term of these Terms of Service shall be deemed a further or continuing waiver of such term or any other term, and Gospel Central's failure to assert any right or provision under these Terms of Service shall not constitute a waiver of such right or provision. Gospel Central reserves the right to amend these Terms of Service at any time and without notice, and it is your responsibility to review these Terms of Service for any changes. Your use of the Service following any amendment of these Terms of Service will signify your assent to and acceptance of its revised terms. YOU AND Gospel Central AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE SERVICES MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.

Welcome to Gospel Central ("GC," "us" "our" and "me"). GC is a platform that allows users to record, share, and view gospel testimonies.

  • The GC Privacy Policy describes how we use, share, collect, store and protect information in relation to our mobile services, web site, and any software provided on or in connection with GC services (collectively, the "Service").
  • When you use our Service you agree and understand that we are providing the Service for you to post gospel content, including videos, comments and other materials ("User Content"), to the Service and to share your User Content publicly. What this means is that other Users may see, share, view, and/or search for any of your User Content that you post through our Service, provided it is in compliance with the terms and conditions of this Privacy Policy and our Terms of Use (which can be found at https://gospelcentral.us/terms).
  • Our Policy applies to all users, including visitors who access the Service ("Users").

1. INFORMATION WE COLLECT

These are types of information that we collect.

  • Your username, password and e-mail address when you register for GC account.
  • Information that you provide for your user profile.
  • User Content (e.g., testimony videos, comments, and other materials) that you post to the Service.
  • Emails and text messages between you and GC related to our service. You can not opt out of Service-related messages.
  • We employ third-party analytics products that help us understand and measure traffic and usage trends for the Service.
